Title of the article | Microdistrict planning in Kazan city with territory zoning for development and use uniform system of living and building cooperation |
Abstract. | The authors propose to realize zoning or the territory attached to all kinds and levels of ownership of land plots and facilities in observance of Russia housing legislation and for protection of the right to ownership on private and common property of housing owners in being built and constructed dwellings. The most complicated problem in realizing the link between town development and complex institute of ownership in the system of housing communal real estate in conditions of imperfect Russia legislation is the problem of forming the institute of common ownership on immoveable property, attribute, of natural monopoly objects. For availing the uncertainty and political arbitrariness in meanings of various rinks of ownership the authors introduce a model, on the basis of which the meaning of cooperative and intercooperatove forms of ownership are developed. It enables the authors realize residential development territory zoning without arising «abandoned real estates», the ownership rights on which occur to be indefinite. The main idea of the authours is that all binds of common ownership, beginning with ground plots, engineering systems providing, the houses with energy and other resources, other facilities, organization and territory green planting on the stage of design occur to be connected with ownership rights of future residential cooperatives and their unions of different levels. The authors suppose that such an approach together with a branched residential cooperation best of all corresponds to the realization of citizens residences rights, provides consolidation of all owners and suppresses arising of «oligarchs» on the level of residences and their unions. |
